NXT LVL MANAGEMENT PTY LTD trading as ‘On the Clarence Camping’ ACN: 635 925 156 (“Site Operator”)
ACCKNOWLEDGEMENT OF RISK
By engaging in our services you are executing this Release and Waiver, the Visitor (or their guardian in the event that they are under the age of 18 years old) acknowledge that by entering and using the facilities, campsites, and services provided by the Site Operator, the Visitor may be engaging in outdoor recreational activities which may involve inherent and obvious risks, including but not limited to:-
Camping, hiking, swimming, fishing, boating, kayaks, canoes, fire use, bush waterslide, 4 wheel driving, motor bikes, quad bikes, ATV’s, tractor, horse riding, push bikes, woodfired sauna, woodfired hot tubs and wildlife encounters;
2. Exposure to uneven terrain, natural hazards, and weather conditions;
3. Risks of injury, illness, allergic reaction, bites, stings, burns, falls, sprains, fractures, or drowning; and
4. Risks arising from equipment failure, negligence of other Visitors, or unforeseeable accidents.
The Visitor understands these risks may result in serious loss or damage to their person or property.
RELEASE AND WAIVER
To the fullest extent permitted by law, the Visitor:-
1. Releases and discharges the Site Operator, its directors, officers, employees, contractors, agents, and volunteers from:-
(a) any claims, demands, actions, or proceedings resulting from their attendance at On The Clarence Campsite (“Property”);
(b) any liability for any loss or damage incurred at the Property.
2. Waives any right to sue or claim compensation for loss, damage or injury suffered as a result of their attendance at the Property.
3. Indemnifies the Site Operator in relation to all claims, losses, damages, costs, and expenses (including legal fees) arising from the Visitor’s attendance at the Property or breach of this agreement.
4. Indemnifies the Site Operator in relation to any claims made by or on behalf of any minor under their care relating to their attendance at the Property.
5. On behalf of any minor under their care, releases the Site Operator in relation to any claims the minor may have to their attendance at the Property.
The Visitor:-
1. Is responsible for:
(a) Their own safety and wellbeing at the Property;
(b) The safety and wellbeing of any minor in their care;
(c) At all times supervising any minor in their care; and
(d) Putting the Site Operator on notice if they become aware of: –
i. Any environmental hazard on the property; or
ii. Any conduct by any visitor that may be a risk to public safety.
2. Acknowledges that:-
(a) The Property may contain environmental hazards that can cause injury;
(b) The Site Operator is not responsible for monitoring the conduct of Visitors;
(c) They attend the Property at their own risk, including the Entrance Right of Carriageway “track in use”;
(d) They will strictly comply with any rules, instructions, or directions provided by the Site Operator or its staff.
(e) This waiver and release is governed by the laws of New South Wales, Australia and any disputes will be subject to the jurisdiction of the courts of New South Wales.
(f) They have read and understood this document and voluntarily agree to its terms.
